Why use a lawyer for inheritance matters?

Can you handle inheritance matters on your own? On the surface, everything about inheritance seems easy and intuitive; in practice it is the most complicated, complex and often not entirely clear.
Why is a lawyer's help advisable in inheritance matters?
Inheritance matters often seem simple until ambiguities appear in the rules or documents, or a conflict arises between heirs. In practice, inheritance proceedings can be legally complex and procedurally demanding. That is precisely why the support of a professional representative, such as an attorney, is in many cases not only helpful but essential.
1. Correctly establishing who the heirs are.
The first step in an inheritance case is to determine who inherits and in what shares. This may follow from statute or from a will. Mistakes at this stage can lead to lengthy disputes, and even to the invalidation of some legal acts.
An attorney:
• reviews the will for its validity,
• checks whether there are other, later dispositions,
• helps establish whether anyone has been omitted (e.g. in the context of the reserved share, zachowek).
2. Support in accepting or rejecting the estate.
An estate is not only assets, but also debts. Within 6 months of learning of your title to inherit, you must decide whether to:
• accept the estate outright,
• accept it with the benefit of inventory,
• or reject it.
An ill-considered decision can mean liability for the deceased's obligations. An attorney will explain the consequences of each option and help you choose the safest solution.
3. Dividing the estate without conflict.
Most disputes arise over the division of the estate, especially where real property, family businesses or significant assets are involved. Often one party wants a sale, another wants to take everything over with an obligation to pay the others.
A professional representative:
• negotiates the terms of division,
• prepares a draft settlement,
• represents the client in court,
• safeguards their financial interests.
This makes it possible to shorten the proceedings and avoid years-long litigation.
4. Reserved-share (zachowek) claims.
The reserved share (zachowek) is a monetary claim available to the closest family members who were left out of the will. Calculating its amount can be complicated and requires establishing the value of the estate, gifts made during the deceased's lifetime, and the statutory shares.
An attorney:
• calculates the amount due (which, contrary to appearances, causes many problems),
• drafts the demand for payment,
• represents the party in court proceedings.
5. Court procedures and formalities.
Inheritance proceedings require:
• properly drafted applications,
• meeting deadlines,
• complete documentation.
Formal errors can delay a case by many months. An attorney knows the procedures and ensures they are followed correctly, minimising the risk of an application being dismissed or a document returned.
6. Protection from manipulation and pressure.
Inheritance matters are often burdened with strong emotions. Family conflicts, pressure from other heirs or a lack of legal knowledge can lead to unfavourable decisions. Having an attorney gives a sense of security and provides professional support based on the law, not on emotion.
Although not every inheritance case requires representation, in practice a lawyer's help significantly increases an heir's legal and financial security. Professional advice helps avoid costly mistakes, shortens the proceedings and helps reach a fair outcome even in difficult, conflict-ridden situations.
